A landlord can bring a summary (housing court) proceeding to recover possession of real property for two reasons: nonpayment of rent or a holdover tenancy (when the tenant has no valid lease). Different rules apply to each preceding and the already complex and technically area of law was made more complicated on June 14, 2019 when legislation was enacted to make evictions take longer and cost more.

Because this is an area of law governing by procedural rules and strict deadlines, it is critical that the statute be followed with respect to pleadings and service rules to avoid the application being dismissed by the Judge.

Lease Drafting

New York statutes dictate that leases must have certain provisions in order to comply with the law. If not, the lease can be voided by the tenant. Certain provisions must be included to shelter a Landlord from liability.
